These terms govern your use of WodGhost, a training application provided by Kinetic House.
Agreement and eligibility
By creating an account or using WodGhost, you agree to these Terms. You must be legally able to enter this agreement and meet the minimum age required in your location. If you use WodGhost for an organization, you confirm you have authority to bind it.
The service
WodGhost provides tools for planning, timing, recording, and reviewing fitness training. Features may change, be added, or be removed as the product develops. We may suspend parts of the service for maintenance, security, or operational reasons.
Health and safety
WodGhost is a training log, not medical advice, diagnosis, or treatment. Exercise involves risk of injury. Consult a qualified professional before beginning or changing a fitness program, especially if you have a medical condition, injury, or concern.
You are responsible for choosing suitable exercises, loads, intensity, equipment, and surroundings. Stop training and seek appropriate help if you feel pain, faintness, or other concerning symptoms. Do not rely on the app where a timer, display, or connection failure could create danger.
Your account
Provide accurate information, keep your credentials confidential, and notify us if you suspect unauthorized access. You are responsible for activity under your account. We may limit or suspend accounts that threaten the service, violate these Terms, or expose others to harm.
Acceptable use
Do not misuse WodGhost, interfere with its operation, attempt unauthorized access, reverse engineer the service except where law permits, upload malicious code, infringe others’ rights, scrape the service at scale, or use it for unlawful, deceptive, or abusive activity.
Your content
You keep ownership of workout plans, notes, and other content you create. You give Kinetic House a limited license to host, copy, process, and transmit that content only as needed to operate, secure, and improve WodGhost. You are responsible for having the rights to content you submit.
Our intellectual property
WodGhost, Kinetic House, the software, design, branding, and related content are owned by us or our licensors and protected by law. These Terms give you a personal, limited, non-exclusive, non-transferable, revocable right to use the service; they do not transfer ownership.
Membership, subscriptions, and purchases
Training features require an active WodGhost membership. Available plans, prices, billing periods, trial terms, and renewal details are shown before purchase. Payment is charged through your app-store account. A subscription renews automatically unless you cancel through your app-store subscription settings before the current period ends.
Cancellation stops renewal but normally keeps access active through the paid period. Restore Purchases can recover an eligible membership associated with your app-store account. Refunds and billing disputes are handled under the app store’s rules and applicable law.
Disclaimers
To the fullest extent permitted by law, WodGhost is provided “as is” and “as available.” We do not guarantee uninterrupted operation, perfect accuracy, preservation of every record, fitness for a particular purpose, or specific training results. Nothing in these Terms excludes warranties that cannot legally be excluded.
Limitation of liability
To the fullest extent permitted by law, Kinetic House will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, goodwill, or opportunity arising from WodGhost. Our total liability will not exceed the greater of the amount you paid for WodGhost in the prior 12 months or €100. These limits do not apply where prohibited by law.
Termination
You may stop using WodGhost at any time. We may suspend or terminate access for a material breach, security risk, legal requirement, or discontinuation of the service. Provisions that by nature should survive termination—including ownership, disclaimers, liability limits, and dispute terms—will survive.
Governing law and changes
These Terms are governed by the laws of Latvia, without regard to conflict-of-law rules, while mandatory consumer protections in your country remain unaffected. Courts in Latvia will have jurisdiction unless applicable consumer law provides otherwise. We may update these Terms and will provide notice when required.
